Family of Indigent Person with Unpaid Nursing Home Expenses Could be Liable for Unpaid Bills in One State

One state has a law in place that may financially obligate an individual for indigent family member’s nursing home expenses. According to the statute, “filial support” creates liability in certain circumstances for a relative’s unpaid care expenses. In 2012, one man was found financially responsible in a court of law for his mother’s $93,000 unpaid nursing home bill. The son was financially supporting her in some aspects, and the mother was unable to pay.

There are few exceptions to this statute. Even if the family member did not act negligently, the statute suggests he or she can still be financially responsible.
