Judge Denies Nursing Home Appeal After Death of Resident Given Unnecessary Medication

A nursing that appealed to the federal appeals court panel has lost its appeal. Instead, the court ruled that the nursing home was responsible for the death of a resident who received diabetes medication she did not need. This week the court reconsidered a jury verdict for the family of the deceased elderly woman. However, the appeal was denied.

The judges stated that the facility displayed conscious disregarded for patient safety.  The elderly woman was found unresponsive in 2007 after it’s believed she was inappropriately given diabetes medication, causing brain dysfunction, diminished quality of life, and death.
