The state Agency for Health Care Administration has issued fine and ordered an assisted living facility to shut its doors. State inspectors arrived at the facility and found that an elderly woman had been restrained in her wheelchair using lap restraints. A court ruled that by not forcing an elderly woman to enter a nursing home is not considered neglect. A guardian of an elderly woman chose not to go against the woman’s wishes and force the woman into a nursing home even though she may need a higher level of care.
