Forced arbitration agreements continue to cause issues for nursing home patients and their loved ones upon experiencing nursing home neglect and abuse. Arbitration agreements forced on the families and patients upon admission are deemed untimely and unfair by nursing home care advocates and families of patients resident at nursing home facilities. When incidents of abuse and neglect arise, arbitration agreements relinquish rights of the injured to elect for jury trials.
Unfortunately, history shows that arbitrators award less and often in favor of the nursing home, as nursing home administrators and owners select the arbitrators. A recent case revealed that the case was awarded in favor of the nursing home facility rather than the injured.
