A former nursing assistant has been released on a $50,000 bail for assaulting an elderly patient at a nursing home. The patient was held unwillingly and sexually assaulted. The nursing assistant believed the patient suffered from dementia and would be unable to relay the incident with credibility.
However, the patient was fully capable of pushing the call button and wedging her walker in the door to prevent the caregiver from returning until morning. She reported the incident to nursing home staff that arrived for their shift the next morning. The nursing assistant could receive up to $100,000 fine and 40 years in jail if convicted.
