The attorney general's office in one state has filed a lawsuit against a nursing home company for advertising high “staff-to-patient” ratios without fulfilling them. The nursing home did not properly staff enough CNA's to service the patients will daily care needed. When surveyors visited facilities, the nursing home increased floor staff with administrative staff to give the appearance of higher levels of direct patient care staffing.
“In reality, when DOH surveyors were not at the nursing home facilities, staffing levels went back down to normal levels and office and administrative staff rarely or never provided direct care to residents,” the lawsuit said.
