Nursing Home Neglect Arbitration Involves Patient Fall And Left Hip Fracture

On December 11, 2008, a 90-year-old female at risk of falling was admitted to the hospital. Three days later, the patient was permitted to fall from her bed, because the hospital staff failed to activate the patient’s bed alarm, or    raise her side rails.

The patient sustained a left interochanteric hip fracture requiring surgery. She remained hospitalized until December 19, 2008, when she was discharged to a nursing home. The patient continued to suffer pain and functional limitations as the result of the hip fracture until her death at the nursing home on March 4, 2009.

The family contacted us to pursue claims against the hospital for failing to provide the patient with proper safety. We were able to obtain a generous award for the family of close to $220,000.00 at arbitration.
