Nursing Home Negligence Case Reaches Supreme Court, Lawsuit Upheld

A nursing home negligence case filed in 2006 has reach the Supreme Court after being appealed by the defendant. The case involves a patient who fell and suffered serious injuries as a result of the fall. The patient was then sent to the emergency room for two surgeries, causing a heart attack and lack of oxygen to the brain, and ultimately death.

The defendant is trying to remove any responsibility. However, the judge had this to say, “Upon review of the facts and record, this court found the relationship between (nursing home) and the decedent is one which weighs in favor of establishing professional obligations and legal duties.”
