A nursing home patient has died and the family is fighting to take the case to court. The patient had a hernia and was cited by state officials for failure to receive proper medical care in a timely manner. The patient had a swollen stomach and was vomiting moments before his death. The facility failed to call 911. His daughter had to make the call.
The patient was taken to the hospital, but did not survive. Now attorneys for the nursing home are holding the family to an arbitration agreement that was signed prior to admission. However, attorneys for the deceased patient are stating that it should not be binding due to the fact the family was told that the room would be offered to someone else if they took the paperwork to an attorney to review before signing.
