Nursing Home Patient Falls, Fractures Ankle, Nursing Home Settles

On December 8, 2012 at a local adult training center, a 57-year-old male was improperly transferred in his room, resulting in a fracture of his right ankle. The patient required the assistance of two staff for all transfers. Unfortunately, the nursing home aide responsible for his care transferred the patient by herself. As a result of the aide’s attempt to transfer the patient alone, the patient sustained the ankle fracture. The aide also failed to report the patient’s injury to a nurse or the shift supervisor even though the patient was in pain and could not extend his right leg.

The family contacted us to pursue claims against the adult training center for failing to provide proper transfer assistance and fall prevention. We were able to obtain a fair award for the patient and his family through settlement, which is confidential at the adult training center’s request.
