Nursing Home Patient Falls, Suffers Fracture, Nursing Home Settles

A nursing home permitted a 73-year-old female patient in their care to fall. On November 20, 2007, the patient was documented by the nursing home to have been found in her bed crying, complaining of right hip and leg pain. Her leg was also shortened. She was sent to the hospital for evaluation of a suspected hip fracture. On admission to the hospital, the patient was diagnosed with a displaced subcapital fracture of the right hip and a UTI. She required surgical hip fracture repair. As a result of the hip fracture, the patient experienced intense right hip pain, which required morphine for pain management.

The family contacted us to pursue claims against the nursing home for failing to provide proper fall prevention. We were able to obtain a generous award for the patient’s family through settlement, which is confidential at the nursing home’s request.
