A nursing home lawsuit is moving forward after a patient was sexually abused by a dementia patient. The family is suing for damages based on the fact that the victim went into a depression, lost 30 pounds and died after the abuse occurred. The nursing home was fined $6,000 and cited for a violation of care. The nursing staff was to be in-serviced regarding appropriate care.
A major aspect of the case and shock to the family involved a nursing supervisor’s testimony that the man had a right to pleasure “including sexual satisfaction and intimacy needs”. The attorney has a different perspective regarding the safety of other patients in the facility, “They were required to be proactive. They were required to notify the family. They didn’t do that.
