One State’s Supreme Court Reversal May Exempt Nursing Home from Alleged Negligent Care

One nursing home named as a defendant in a lawsuit for alleged negligent care may be exempt legally, according to one state’s Supreme Court ruling. According to the new ruling, this nursing home may be able to claim special immunity due to its “charitable status.” The state’s Supreme Court reversed the prior decision made by the state’s Court of Appeals, which previously asserted no immunity could be sought.

According to the Supreme Court justices, a jury concluded the prior decision. The reversal argued that this specific legal matter should be decided by judges versed in the law, not a jury. For more, read the story.
